1. Who we are and what these Terms cover

OrbGIS is a web-based geographic information system (GIS) platform provided by OrbGIS AB, a company registered in Sweden with organization number 559598-2785 and registered address Olaus Magnus väg 48, 121 38 Johanneshov (“OrbGIS”, “we”, “us”). These Terms of Service (the “Terms”) govern your access to and use of the OrbGIS platform, including the web portal, published content pages, the OrbGIS QGIS plugin, and any related APIs (together, the “Service”).

By creating an account, accepting an invitation to an organization, or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, public authority, or other organization (the “Customer”), you confirm that you are authorized to bind that organization, and “you” refers to it. The Service is intended for professional use; you must be at least 18 years old to create an organization.

2. The Service

The Service lets you upload geographic data, host it as feature layers, and build and share maps, dashboards, journeys (story maps), surveys, print layouts, and other content within an organization or publicly. The Service is hosted in Sweden.

3. Accounts and organizations

  • You must provide accurate registration information and keep your login credentials confidential. You are responsible for all activity under your account.
  • Content in the Service belongs to an organization. Organization administrators control membership, roles, and privileges within their organization, including inviting and removing members and controlling what members can create, edit, publish, and delete.
  • Notify us without undue delay if you suspect unauthorized access to your account or organization.

4. Acceptable use

You agree not to, and not to permit anyone using your account to:

  • use the Service in violation of applicable law or third-party rights;
  • upload or publish content that is unlawful, infringing, defamatory, or that you do not have the right to use;
  • attempt to gain access to data belonging to other organizations, probe or circumvent access controls or tenant isolation, or test the Service for vulnerabilities without our prior written consent;
  • place unreasonable load on the Service — for example bulk-scraping map tiles or APIs outside normal application use;
  • resell, sublicense, or provide the Service to third parties as a service bureau;
  • upload malware or use the Service to distribute it.

5. Customer Content

“Customer Content” means all data and content you upload to or create in the Service, including geographic datasets, attributes, maps, dashboards, journeys, surveys and survey responses, layouts, and media.

  • You own it. We claim no ownership of Customer Content. You grant us a limited, non-exclusive license to host, store, process, transmit, and display Customer Content solely as needed to provide and support the Service.
  • You are responsible for it. You warrant that you have the necessary rights to the Customer Content you upload and that your use of it in the Service complies with applicable law, including data protection law where the content contains personal data.
  • Where Customer Content contains personal data, we process it as your processor under the Data Processing Agreement, which forms part of these Terms.

6. Publishing content publicly

The Service lets you publish maps, dashboards, journeys, and surveys to publicly accessible pages. Published content is available to anyone who can reach the page, without authentication. You decide what to publish and are responsible for the published content, including making sure it contains no personal data or confidential information that should not be public. You can unpublish content at any time; copies cached by third parties (for example search engines) may persist outside our control.

7. AI features

Some features can generate text or expressions using a third-party AI provider (currently Berget AI, with processing in Sweden). These features run only when you actively invoke them, and the content you submit to them is sent to the provider for processing — see the Privacy Policy. AI-generated output can be inaccurate; you are responsible for reviewing it before relying on or publishing it.

8. Third-party services

Background maps (basemaps) are loaded by your browser directly from third-party providers and are subject to those providers’ terms. We may change or remove available basemaps. The QGIS plugin works with QGIS, third-party open-source software we do not control.

9. Fees

The Service is currently offered free of charge. We may introduce paid plans; if we do, pricing will be published in advance and no existing organization will be moved to a paid plan without notice and a chance to export data and close the account. Any future paid plans will be governed by the pricing terms presented at purchase.

10. Intellectual property

The Service, including its software, design, and documentation, is owned by us or our licensors and is protected by intellectual property law. We grant you a non-exclusive, non-transferable right to use the Service during the term of your agreement with us. If you give us feedback or suggestions, we may use them without obligation to you.

11. Availability, support, and changes to the Service

We aim to keep the Service available and performant but do not guarantee uninterrupted or error-free operation, and no service level agreement applies unless separately agreed in writing. We may perform maintenance, and we may change or discontinue features; if we discontinue the Service or a material feature, we will give reasonable advance notice so you can export your data. Support is provided by email on a reasonable-efforts basis.

12. Data protection

How we process personal data relating to your account is described in the Privacy Policy. For personal data inside Customer Content, the Data Processing Agreement applies.

13. Data export, retention, and deletion

  • You can export your data from the Service in standard formats at any time.
  • Content deleted in the portal is moved to a recycle bin, where it can be restored by your organization for 30 days before being permanently purged. Purged content cannot be recovered.
  • When your organization is terminated, we delete its Customer Content within a reasonable period after termination, except where retention is required by law. Residual copies in backups are deleted as backups rotate out.

14. Suspension and termination

  • You may stop using the Service and request account deletion at any time.
  • We may remove or disable access to specific Customer Content that we reasonably believe is unlawful or infringes third-party rights. Where practical, we will notify you so you can respond or remedy the issue.
  • We may suspend or terminate access with immediate effect if you materially breach these Terms (including the acceptable-use rules), if required by law, or to protect the Service, other customers, or third parties. For less serious breaches we will, where reasonable, notify you and give you an opportunity to remedy the breach first. For serious wrongdoing — such as unlawful or infringing content, attacks on or abuse of the Service, or attempts to access other organizations’ data — we may suspend or terminate without prior notice.
  • Sections that by their nature should survive termination survive it.

15. Disclaimers

The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. Geographic data, analysis results, and rendered maps are provided for informational purposes; you are responsible for verifying they are suitable for your use, in particular before using them for decisions with legal, safety, or financial consequences.

16. Limitation of liability

To the extent permitted by applicable law: (a) neither party is liable for indirect or consequential damages, including loss of profit, revenue, or data (except for a party’s indemnification obligations and your breach of Sections 4–5); and (b) our total aggregate liability under these Terms is limited to the greater of the fees you paid us in the 12 months preceding the claim and SEK 5,000. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under mandatory law.

17. Indemnification

You will indemnify us against third-party claims arising from Customer Content or your use of the Service in breach of these Terms, provided we notify you promptly of the claim and reasonably cooperate with you.

18. Changes to these Terms

We may update these Terms; the current version is always available at this page. For material changes we will give at least 30 days’ notice by email or in the Service, and you may be asked to accept the updated Terms to continue using it. If you continue to use the Service after updated Terms take effect, the updated Terms apply to you. If you do not agree to the updated Terms, you may terminate and export your data before they take effect. The “Last updated” date above states when the current version took effect.

19. Governing law and disputes

These Terms are governed by Swedish law, without regard to its conflict-of-law rules. Disputes that cannot be resolved amicably shall be settled by Swedish courts, with Stockholm District Court (Stockholms tingsrätt) as the first instance, unless mandatory law provides otherwise.
